Kitl s.r.o., IČO: 46712518, with its registered office at Pasířská 3299/60, Jablonec nad Nisou, Czech Republic (hereinafter referred to as “Kitl”), protects all personal data provided by customers (their names, surnames, addresses, telephones, e-mails, cookies, access data) against misuse and process it in accordance with current legislation. Because the security of your personal information is important to us, and we want you to continue to enjoy all the benefits of our products, services and promotions without restriction, we would like to introduce some new rules and information related to the new European data protection legislation. Therefore by the GDPR, effective from 25 May 2018 throughout the European Union.

In this document, we have written to you all information we collect about our customers' personal information for the purpose of providing services, in particular the fulfillment of orders and related services, what personal data we process, whom we can pass on them to, and what are your options regarding our personal data processing of your data. A. What personal information does Kitl s.r.o. processes?

A.1.1 Kitl s.r.o. processes the following personal information:

  • a) the customer's identification data, ie in particular the first and last name, the user name and password in encrypted form;
  • b) customer contact details, ie personal data allowing access, such as e-mail address, postal address, telephone number;
  • c) customer settings, ie data stored in his account, in particular addresses;
  • d) customer order details, ie details of the goods and services they order;
  • e) customer behavior data on the site, ie the goods and services that they display, the links they display, the way we navigate our site with parameters such as the operating system, its version, screen resolution, browser used, and version and data obtained from cookies and other equipment identification technologies including location and access data;

 

B. Why Kitl s.r.o. does it process personal data and what entitles it to it?

We process these personal data for the purpose of performing the contract, for example, to process orders and send them to the delivery address and other activities to ensure the functionality of the services. We process personal data for security and legal reasons. Here are some examples:

To process your order, ie to fulfill the contract between Kitl and the customer, we use your name and contact details. Data processing in this case includes all activities from registering the order, processing it, including paying and delivering the ordered goods. If data is not provided, Kitl cannot process your order.

To offer our customers' products in the form of business communications, we primarily use an e ‑ mail address, exceptionally a telephone number. Processing in this case is only based on your consent, which is entirely voluntary and its granting is not a condition for the purchase of the goods or the use of the website in its entirety. You grant the Company's consent during registration on the website or later in the settings of your user account. You may revoke your consent at any time by clicking on the appropriate link located in each commercial communication or in the user account settings.

To better target advertising and promotion, Kitl processes cookie information about website visits, products viewed, and other activities on the site. Processing is only possible on the basis of your consent using the appropriate cookies. Even this consent is completely voluntary. Usually, based on the data provided, the Company obtains statistics, analyzes and reports on website users' behavior. As a result, it is then possible to better target your ad or customize the content of your website to what you are really interested in and what you are looking for, or if you are generally interested in a larger group of users. Customer may grant Kitl consent to receive information, news and business communications regarding the Company's goods and services via e-mail and customer's mailing address.

Kitl never gives your data to third parties for direct marketing unless you give us explicit consent.

To a strictly limited extent, we provide the necessary personal information to our service providers who are (among other things) responsible for delivering the goods you have ordered. These service providers are contractually bound to keep your data confidential to the same extent as Kitl.

Customer is always required to provide accurate personal information. In the event of any changes to the personal data, including the omission of their processing, Customer is obliged to inform Kitl immediately. In the event that the customer specifies third party personal information, it is the responsibility of the customer to obtain and transmit such data to Kitl in accordance with applicable law, including, where appropriate, obtaining the consent of third parties.

The website is not aimed at children and does not knowingly request or collect personal information from persons under 18 years of age. If we find out that we have inadvertently acquired the child's data, respectively. from under 18, we will remove the data from our records without delay. However, Kitl can collect personal information about children, respectively. from persons under the age of 18, from their parents or legal guardian by their express consent.

C. Who processes customer data and who is Kitl s.r.o. passes?

All personal data mentioned above is processed by Kitl s.r.o. as an administrator. That is, Kitl s.r.o. it sets out the purposes defined above for which the customer collects personal data, determines the means of processing them and is responsible for their proper execution.

It also uses the services of other processors to process personal data, who process personal data only as directed by Kitl s.r.o. and for the purposes described in Part B, see above. Such processors are:

  • a) cloud service providers and other technology and support suppliers;
  • b) marketing tool operators who assist Kitl s.r.o. with site optimization and personalization of content and offers for its customers;
  • c) mail service providers, including, in particular, their couriers;
  • d) service providers which are strictly necessary for the execution of orders.

 

D. From what sources does Kitl s.r.o. is it getting personal information?

Kitl s.r.o. as a rule, it processes personal information provided by customers directly in ordering services, creating and using the account, or communicating with it, for example, by e-mail or in a customer center. These personal information is obtained directly from the customers by Kitl based on their behavior on the Eligin.com website.

 

E. Information Security

All the information that Kitl s.r.o. have collected, stored and secured in their systems, only authorized employees or workers have access. Working with Kitl s.r.o. adheres to all regulations laid down by law and regulations of the Czech Republic and the European Union. It keeps its systems under constant surveillance and, in order to ensure the confidentiality of users 'personal data, continuously puts into practice the latest security knowledge and measures to reduce the risks associated with unauthorized access or loss, damage or deletion of users' personal information.

 

F. What rights does the customer have when processing personal data?

a) the right of access, under which the customer has the right to know what data we are processing about him, for what purpose, for how long we receive his personal data, to whom we pass it on, who processes it outside the company, and what customer has other rights relating to the processing of personal data. All of this information can be found above. If the customer is not sure what personal information about him Kitl s.r.o. can process this information, and if the company processes the data, the customer has the right to access it. Under the right of access, the customer may request a copy of the personal data being processed. The first copy is free, another copy is charged.

b) the right to transfer data - in the case of personal data that Kitl processes automatically, the customer has the right to obtain the provided personal data from Kitl in a commonly used format, or has the right to request that it be passed on to another administrator.

c) the right to rectify processed personal data that is inaccurate or incomplete, under which the customer is entitled to have it rectified or supplemented without undue delay by the customer after due verification of the customer's identity.

d) the right to erasure, in which the customer may, in some cases, have the right to delete his personal data without undue delay. These are the following:

  • the company no longer needs the customer's personal data for the purposes for which it has processed it
  • the customer withdraws his / her consent to the processing of personal data, the data for which his / her consent is necessary and at the same time the company has no other reason for further processing of the data
  • the customer uses his right to object to the processing of personal data processed by the company based on his legitimate interests, and the company finds that no longer any legitimate interests justifying such processing
  • the customer believes that the processing of personal data by the company has ceased to be in accordance with generally binding regulations.

This right of cancellation shall not apply if the processing of the customer's personal data remains necessary to fulfill the company's legal obligation or to determine, exercise or defend its legal claims.

e) the right to a restriction on the processing that may be used by the customer in addition to the erasure right and in which he may in certain cases require his personal data to be identified and no further processing operations to be carried out, not forever (such as in the case of a right of cancellation), but only for a limited period.

f) the right to object to processing whereby the customer may object to the processing of personal data processed by the Company on the basis of its legitimate interest. As far as marketing activities are concerned, the company ceases to process the customer's personal data without further notice; in other cases, it will do so unless it has reasonable grounds for continuing such processing.

g) the right to lodge a complaint enabling the customer to lodge a complaint with the competent supervisory authority, despite the exercise of the abovementioned rights. This right can be exercised by the customer especially if he / she considers that his / her personal data is being processed by the Company unlawfully or in violation of generally binding legal regulations. Complaints against companies processing personal data may be submitted by the customer to the Office for Personal Data Protection in the Czech Republic - website www.uoou.cz.
